The Pep Boys – Overtime Pay Lawsuit for Mechanics and Technicians

We currently represent a group of Pep Boys Mechanics and Technicians who are paid on a flat rate pay system. This case is for unpaid overtime wages and initially involved a class of over 5,600 hourly and flat rate employees.  The only issue remaining in this case is whether the mechanics and technicians paid on a flat rate are entitled to overtime wages.  In September 2006, the United States District Court for the Middle District of Tennessee determined that these employees are entitled to overtime pay.  Pep Boys has appealed the decision to the United States Court of Appeals for the Sixth Circuit.  The case is currently on appeal.
